Selling a vehicle from an estate
handled properly, not quickly

Somebody died and there's a car. You're handling more than you should have to right now, and this is one more thing with rules you didn't know existed. Most buyers make it harder — they want a clean title from a living owner and don't know what to do when the name on the title belongs to someone who's gone. We do this regularly, and we don't rush people through it.

Ohio treats a vehicle in an estate differently depending on the situation, and the paperwork changes with it.

If there's a surviving spouse, they can often transfer a vehicle without full probate, within limits. If the title carries a transfer-on-death designation, it passes to the named person directly. If neither applies and the estate is in probate, the executor or administrator handles it with court authority.

Getting this wrong means the sale unwinds later. A buyer who takes a car signed by someone without authority can end up unable to register it, and that comes back to the estate. It's worth doing correctly the first time even though it's slower.

Helpful to have: the vehicle title, a certified copy of the death certificate, and the keys. If there's a probate case, the letters of authority naming the executor or administrator. If there's a surviving spouse, their ID and the marriage record. If the title has a transfer-on-death name on it, that person's ID.
